Assisted Reproduction goes by various names.  You may hear it referred to as ART (Assisted Reproductive Technology), Third Party Reproduction, or Third Party Fertility.  It is still a new area of law that remains unsettled in many states, and the laws are constantly changing, as is the science and technology.  Laws vary widely state by state, and last year’s information may not be accurate.  It is important to hire an attorney who has experience with assisted reproduction contracts, who will listen to your concerns, and guide you through the process.

Egg donation has is being used by many families today, and there are a wealth of egg donor agencies throughout California. We are proud to work with many of these agencies. Egg donors are generally under the age of 30, and they donate healthy eggs using an egg retrieval process involving the stimulation of the ovaries. A thorough evaluation or screening of each potential egg donor is of critical importance, whether the donor is known to the recipient or is anonymous. This screening is served to protect all parties involved (the donor, the recipient and the resulting children). Assisted reproduction contracts between egg donors and Intended Parents must be negotiated prior to starting any egg donation and retrieval program. Our firm drafts contracts for ovum donation to meet the individualized needs of each of our clients’ situation.   We also review contracts on behalf of egg donors, and work with both agency agreements involving anonymous donors and private arrangements with known donors. 

SPERM DONATION

Many single women and same sex couples make use of known sperm donors in creating their families.  Is is important to lay out the expectations of the future relationship prior to the sperm donation.   A donor agreement lays out each party’s rights and obligations, and it addresses legal issues such as parental rights, confidentiality, future contact, medical expenses, and the rights of the child.  We can create an agreement tailored to your needs, negotiate the terms and can also review an agreement on behalf of a sperm donor.

EMBRYO DONATION 

Many couples who have used IVF (In Vitro Fertilization) or other assisted reproduction methods to create their families have additional embryos they do not plan to use.  Some families choose to donate these embryos to others who are trying to conceive.  We can craft an agreement for you that reflects your needs and the desires of the donating family.
